Terms of Service

1. Acceptance of Terms

By accessing or using Upcycle Hub ("Service"), operated at myupcyclehub.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

Upcycle Hub is a platform that:

  • Pickup Service: Connects customers seeking junk removal, donation pickup, and item hauling with independent service providers
  • Upcycle Mall: Provides a marketplace for buying and selling secondhand items
  • Upcycle News: Offers editorial content about sustainability, reuse, and community resources

Important: Upcycle Hub is a platform only. We do not directly provide junk removal services. All pickup services are performed by independent contractors who are solely responsible for their work.

3. User Accounts

  • You must be at least 18 years old to use our Service
  • You are responsible for maintaining the security of your account
  • You must provide accurate and complete information
  • You may not share your account credentials with others
  • You are responsible for all activity under your account

4. Pickup Service — Customer Terms

4.1 Booking Services

  • Quotes are estimates based on information you provide
  • Final pricing may vary based on actual conditions
  • You must accurately describe items for removal
  • You must ensure safe and accessible work conditions
  • Photos help ensure accurate quotes

4.2 Prohibited Items

You may not request removal of:

  • Hazardous materials (without prior arrangement)
  • Illegal items or contraband
  • Medical or biohazardous waste
  • Items you do not own or have authority to dispose

4.3 Cancellation

  • Free cancellation before a provider is assigned
  • Cancellation fees may apply for last-minute cancellations (within 24 hours of scheduled pickup)
  • Refunds processed within 5-7 business days

5. Pickup Service — Provider Terms

5.1 Independent Contractor Status

Service providers are independent contractors, not employees of Upcycle Hub. Providers are solely responsible for their business operations, taxes, insurance, and compliance with applicable laws.

5.2 Provider Obligations

  • Maintain appropriate licenses and insurance
  • Complete jobs professionally and safely
  • Prioritize donation and recycling over landfill disposal
  • Dispose of items in compliance with local regulations
  • Respect customer property and privacy
  • Communicate clearly with customers about timing and scope

5.3 Platform Fees

Upcycle Hub charges a platform fee on completed jobs. Fees are deducted from provider payouts automatically via Stripe Connect. Current fee structure is available in the Provider Dashboard.

6. Upcycle Mall Terms

6.1 Marketplace Rules

  • Sellers must accurately describe items and disclose defects
  • Sellers must have legal authority to sell listed items
  • Buyers and sellers are responsible for their own transactions
  • Upcycle Hub may remove listings that violate these terms

6.2 Prohibited Listings

You may not list:

  • Stolen property
  • Hazardous materials
  • Recalled products
  • Weapons or illegal items
  • Counterfeit goods

6.3 Liability

Upcycle Hub is a venue for transactions, not a party to them. We do not guarantee the quality, safety, or legality of items listed. Disputes between buyers and sellers should be resolved directly.

7. Payments

  • All payments are processed securely through Stripe
  • We do not store credit card information
  • Payment is required before service confirmation
  • Provider payouts are processed after job completion

8. Content and Intellectual Property

The Upcycle Hub platform, including its design, features, and content (including Upcycle News articles), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

By uploading photos or content, you grant us a non-exclusive license to use that content for providing and improving our services, including marketing and promotional purposes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We provide the platform "as is" without warranties
  • We are not liable for actions of service providers
  • We are not liable for property damage during services
  • We are not liable for marketplace transactions between users
  • Our liability is limited to fees paid in the past 12 months
  • We are not liable for indirect, consequential, or punitive damages

10. Indemnification

You agree to indemnify and hold harmless Upcycle Hub and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or use of our Service will be resolved through binding arbitration in Sacramento County, California, in accordance with the rules of the American Arbitration Association.

You waive your right to participate in class action lawsuits against Upcycle Hub.

12. Service Area

Upcycle Hub's pickup service currently operates in the Sacramento, California metropolitan area. Service availability may expand over time.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
